How do you accept these Terms?

By creating an account or using any part of GPT Image 2 at gptimager.com, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. These Terms constitute a legally binding agreement between you and the operator of GPT Image 2. We may update these Terms from time to time; continued use after an update constitutes acceptance of the revised Terms. Material changes will be communicated by email at least 14 days in advance.

Who is eligible to use the service?

You must be at least 13 years old to use GPT Image 2. If you are between 13 and 18, you may only use the service with the verified consent of a parent or legal guardian. By registering, you represent that: (1) you are at least 13 years old; (2) you have the legal capacity to enter into a binding contract; (3) your use will comply with all applicable local, national, and international laws. Users located in jurisdictions where AI-generated content is restricted or prohibited are responsible for compliance with their local laws.

How do accounts and registration work?

You must create an account to use the service. You agree to: (1) provide accurate and complete registration information; (2) keep your password secure and not share your credentials with others; (3) notify us promptly at support@gptimager.com if you suspect unauthorized access to your account; (4) accept responsibility for all activity that occurs under your account. Each account is for a single individual. Organizations wishing to allow multiple team members should contact us for enterprise options. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

What are you permitted to use the service for?

GPT Image 2 is a professional AI image generation tool. You may use it to: (1) generate images for personal, creative, or commercial projects, subject to your plan's license terms; (2) use generated images in marketing materials, products, publications, and other commercial works (paid plans only); (3) experiment with prompts and reference images for artistic or design workflows. You are responsible for ensuring any prompts or reference images you submit do not infringe third-party rights.

What content and uses are prohibited?

The following are strictly prohibited and will result in immediate account termination without refund: (1) Generating sexually explicit, pornographic, or NSFW content of any kind; (2) Creating deepfakes, non-consensual intimate imagery, or realistic depictions of real individuals in false or defamatory contexts; (3) Generating content that incites violence, promotes hate speech, or targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, or disability; (4) Producing content that infringes copyrights, trademarks, or other intellectual property rights; (5) Attempting to circumvent safety filters, jailbreak the AI model, or generate content that violates OpenAI's or fal.ai's usage policies; (6) Using the service to produce CSAM (child sexual abuse material) — this is illegal and will be reported to law enforcement; (7) Automated bulk generation without prior written permission; (8) Reselling API access or sublicensing the service to third parties.

Who owns the images you generate?

You retain ownership of the images you generate using GPT Image 2, subject to the following license terms: (1) Starter, Creator, and Studio plan subscribers receive a perpetual, worldwide, royalty-free commercial license to use, reproduce, distribute, modify, and sell outputs generated during an active subscription. (2) The underlying AI model weights and the GPT Image 2 platform remain the property of their respective owners. (3) Because AI-generated images may not qualify for copyright protection under current law in all jurisdictions, we recommend consulting a legal professional if copyright ownership is critical to your project. (4) You grant us a limited license to store and display your generated images solely to provide the service.

How do credits work?

The service operates on a credit-based system: (1) Each image generation consumes credits based on the selected model quality, resolution, and number of outputs. The credit cost per generation is shown before you confirm. (2) Subscription credits are allocated each billing cycle (monthly or annual) and reset on your renewal date. Unused subscription credits do not roll over to the next cycle. (3) Any separately purchased credit pack credits do not expire as long as your account remains active. (4) Credits have no cash value and are non-transferable between accounts. (5) We reserve the right to adjust credit costs for specific generation parameters; any such changes will be announced in advance.

What are the subscription plans and billing terms?

GPT Image 2 offers the following paid plans: Starter ($19.90/month), Creator ($49.90/month), and Studio ($79.90/month). Annual billing is available at approximately 50% off the monthly rate. There is no free plan. (1) Subscriptions are billed in advance on a recurring basis — monthly or annually depending on the plan you select. (2) Payments are processed by our payment processor. By subscribing, you authorize the payment processor to charge your payment method on each renewal date. (3) Prices are shown in USD. Additional taxes may apply based on your location. (4) You may upgrade or downgrade your plan at any time; changes take effect at the start of the next billing cycle. (5) We reserve the right to modify pricing; existing subscribers will receive 30 days' advance notice before any price increase takes effect.

How do you cancel your subscription?

You may cancel your subscription at any time from your account dashboard or by emailing support@gptimager.com. (1) Cancellation takes effect at the end of your current paid billing period — you retain full access to the service until then. (2) After cancellation, your account reverts to an inactive state; you will lose access to subscription-level features and any remaining subscription credits at the end of the period. (3) Any separately purchased credit pack credits remain accessible as long as your account is active. (4) Cancellation does not automatically entitle you to a refund. What is the refund policy?

First-time subscribers may request a full refund within 7 days of the initial payment, provided fewer than 50 credits have been used. Subscription renewals are non-refundable. Credit packs are non-refundable once any credits have been used. If you believe you were charged in error, contact us within 30 days. What are the limitations of liability?

To the maximum extent permitted by applicable law: (1) GPT Image 2 is provided 'as is' and 'as available' without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. (2) We do not guarantee uninterrupted, error-free service or that outputs will meet your specific requirements. (3) Our total cumulative liability to you for any claims arising from your use of the service shall not exceed the amount you paid us in the 3 months preceding the claim. (4) We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if advised of the possibility of such damages. Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the fullest extent permitted by law.

What disclaimers apply to AI-generated content?

AI image generation is an emerging technology with inherent limitations: (1) Outputs may be unpredictable and do not always match prompt intent. We cannot guarantee any specific result for any prompt. (2) AI models may occasionally produce content that resembles copyrighted works, real individuals, or trademarked imagery without intent. You are responsible for reviewing outputs before commercial use. (3) GPT Image 2 makes no representation that AI-generated images are legally protectable as original works under copyright law. (4) We are not responsible for how you use generated images. You assume full legal responsibility for any downstream use of outputs from the service. (5) The service relies on third-party AI infrastructure (fal.ai, OpenAI); service availability and model behavior are subject to their platform conditions.

Can we suspend or terminate your account?

We reserve the right to suspend or permanently terminate your account, with or without notice, if: (1) you violate any provision of these Terms; (2) your account is associated with fraudulent, abusive, or illegal activity; (3) your continued use poses a security or legal risk to the service or other users; (4) required by law or a valid government order. In the event of termination for policy violations, no refund will be issued. If you believe your account was suspended in error, contact support@gptimager.com.

What law governs these Terms?

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or the courts of the jurisdiction applicable to the operator, unless prohibited by your local consumer protection laws. Nothing in these Terms limits any rights you may have under mandatory consumer protection legislation in your country of residence.
